A man from Helena has been charged with sexual abuse of a child in Alfalfa County. Court records show Kirby Tyler McNary, 36, of Helena, has been charged with two counts of child sexual abuse and one count of sexual battery, all felonies. McNary was reported to have fled to Missouri.
According to the affidavit on file, on April 18 Helena Police Chief Jim Dykes was notified by a woman that her 15-year-old daughter had been sexually assaulted by McNary.
On April 20 Dykes observed a forensic interview of the girl conducted by District Attorney’s Investigator Steve Tanio. She said on April 9 she went to her upstairs bedroom to sleep. She said McNary came into her bedroom and was lying on her on top of the covers. She recalled his attempting to kiss her, and then she fell asleep. The next morning when she woke, the underwear, shorts and t-shirt she wore to bed had been removed. She said later McNary told her not to tell anyone what happened.
Also on April 20 Tanio interviewed the mother with Dykes observing. The mother said she confronted McNary, and he responded he had made “a mistake.” She said she later learned he had fled to his mother’s residence in Missouri.
On April 25, Dykes observed a forensic interview conducted by Tanio of a 17-year-old female who had been friends with the younger girl’s brother since the age of 14. She said because she did not have a driver’s license and regularly traveled to her friend’s Helena residence, McNary often picked her up from her home to drive to visit. She said on almost every occasion, McNary would follow behind her as she entered the residence and spanked her on the butt with his hand, which made her “feel very uncomfortable.” She said this happened on at least 20 occasions.
The 17-year-old said on July 5, 2021, she was at the Carmen fireworks celebration when she received a ride back to her residence from McNary. She said McNary draped his arm over her shoulders and squeezed her breast. She moved to the far side of the passenger seat.
Charges were filed on April 26 in Alfalfa County, and a warrant has been issued for McNary’s arrest.
