Harrah man charged with obtaining $1,650 under false pretenses

A felony warrant has been issued for a Harrah man on a Woods County charge. David James Downey, 47, of Harrah, has been charged with felony value false pretenses and/or con game. This crime is punishable by imprisonment in the custody of the Department of Corrections for a term not to exceed two years or in the county jail for a term not to exceed one year, or by a fine not to exceed $5,000, or by both such fine and imprisonment.

Court documents show on March 8 James Wilson of Wilson Construction went to the Woods County Sheriff’s Office to file a report for fraud. Wilson told Deputy Kaleb Keplinger he had contracted David J. Downey to put new windows in a residence at 602 Sherman Street in Alva.

Wilson said he contracted with Downey and his business in May of 2020 to replace four windows in the residence. He said Downey required a deposit for the windows up front. Wilson said he provided Downey with $1,650 to secure the deposit, and Downey was to order the windows.

Wilson provided a copy of the check from his bank written to Downey on May 24, 2020 for $1,650. The bank copy shows Downey cashed the check on May 26.

Wilson told Keplinger that Downey never delivered the windows and kept the $1,650.

Wilson said he made multiple attempts to contact Downey from May 2020 up to the present and was unable to reach him. Wilson showed Keplinger text messages from Downey saying he would call Wilson back and he never did over a period of ten months.

The felony charge against Downey was filed in Woods County on March 23.
