JEFFERSON CITY, Mo. (AP) — A state appeals court panel has ruled that the Missouri Department of Corrections still owes a woman who worked at the Tipton Correctional Center and the Kansas City Release Center nearly $2 million in damages, attorney fees and litigation costs.
The Jefferson City News-Tribune reports that the court on Tuesday sent the case back to the trial court in Kansas City to determine how much more Debra Hesse should get for her attorneys' fees during the appeal process. Hesse sued the department in 2014 for gender harassment and retaliation.
The department argued in its appeal that Judge W. Brent Powell had abused his discretion by awarding Hesse attorney fees unreasonable under terms of the Missouri Human Rights Act. The appeals court disagreed, finding that the Powell's judgment was "properly considered."
